Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Avalanche Factory ("we," "our," or "us"). We apply our hypercasual "test to kill" methodology to everything - including how we structure these terms. By using our Apps, you agree to these Terms and join our mission to disrupt utility app development.

If you don't agree to these Terms, please don't use our Apps. We build for users who embrace rapid innovation and market disruption.

Terms Evolution

Like our Apps, these Terms evolve rapidly. We may update them as we scale our methodology and enter new markets. Changes are effective immediately when posted. Your continued use means acceptance - simple and transparent.

App Access & Performance

Our Apps are built with gaming-industry performance standards. We reserve the right to modify, update, or temporarily disable our Apps for rapid iteration cycles, new feature testing, or infrastructure improvements.

You're responsible for:

• Ensuring device compatibility with our rapidly evolving Apps.
• Maintaining internet connectivity for real-time features and updates.
• Understanding that some features may be A/B tested - you might see different versions.

Intellectual Property

Our Apps, methodology, and AI-driven systems represent significant innovation. All content, features, algorithms, and designs are owned by Avalanche Factory and protected by intellectual property laws. This includes our proprietary hypercasual development methodology.

You may: Use our Apps for personal purposes and enjoy the experience.
You may not: Reverse engineer, copy, or attempt to replicate our methodology or systems.

Acceptable Use

Use our Apps to enhance your life, not disrupt others'. You agree not to:

• Violate any laws or regulations while using our Apps.
• Attempt to hack, exploit, or damage our systems or other users' experiences.
• Impersonate others or misrepresent your identity.
• Use our Apps for spam, harassment, or any harmful activities.
• Interfere with our rapid iteration processes or testing methodologies.

User Content & Feedback

Our Apps may include features for user-generated content. Any content you create becomes part of our rapid iteration feedback loop. By submitting content, you grant us rights to use it for app improvement and testing.

Your feedback helps us validate or kill features quickly - it's invaluable to our methodology.

Subscriptions & Payments

Our Apps may offer premium features through subscriptions:

• Billing: Charged to your App Store or Google Play account at purchase confirmation.
• Auto-renewal: Subscriptions continue unless cancelled 24+ hours before renewal.
• Management: Control subscriptions through your device's app store settings.
• Refunds: Handled according to App Store and Google Play policies.
• Feature Testing: Premium features may be A/B tested for optimization.

Service Disclaimer

OUR APPS ARE PROVIDED "AS IS" WITH THE UNDERSTANDING THAT WE RAPIDLY ITERATE AND IMPROVE. WHILE WE STRIVE FOR EXCELLENCE, WE DISCLAIM WARRANTIES REGARDING ABSOLUTE PERFECTION - THAT'S NOT HOW INNOVATION WORKS.

We test ideas rapidly, which means some features may change, evolve, or be discontinued based on user data and market validation.

Liability Limitation

AVALANCHE FACTORY, ITS TEAM, AND PARTNERS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM APP USE. WE'RE BUILDING THE FUTURE OF APP DEVELOPMENT - INNOVATION INVOLVES CALCULATED RISKS.

Our maximum liability is limited to the amount you've paid for our Apps in the past 12 months.

Governing Law

These Terms are governed by French law. Any disputes will be resolved in French courts.
